    This rulemaking adopts the blanks and instructions established by the NAIC for annual statements and supplements for reporting years 2005 and 2006.

  3. ADOPTS AND AMENDS OF RULES RELATING TO THE CHARGING AND DISCLOSURE OF FEES BY INSURANCE PRODUCERS AND CONSULTANTS

    This rulemaking permanently adopts temporary rulemaking that establishes minimum terms of disclosure when an insurance consumer pays compensation to an insurance producer and the transaction is not subject to ORS 735.455, 744.091 or 744.093, or pays compensation to an insurance consultant who also receives other compensation.

  4. TEMPORARILY AMENDS OREGON ADMINISTRATIVE RULES RELATING TO LONG TERM CARE INSURANCE

    This temporary rulemaking corrects two problems with the amended rules governing long term care insurance that were adopted earlier this year. The effective date of the rule relating to premium rate schedule increases is delayed and the rule governing review of advertising for long term care insurance is amended to provide for review only upon request of the Insurance Division.

  5. TEMPORARILY AMENDS OREGON ADMINISTRATIVE RULES RELATING TO CREDIT SCORING

    OAR 836-080-0430 and 836-080-0438
    This temporary rulemaking corrects an error in a recent amendment to this rule. OAR 836-080-0430 was amended in 2004 to delete provisions relating to the use of credit history or insurance score in connection with rating a policy at renewal in order to conform the rule to 2003 legislation but a subsequent amendment in 2005 for another purpose inadvertently restored the deleted wording. This temporary rulemaking also corrects and updates an obsolete statutory reference in a related rule.

  6. AMENDS OREGON ADMINISTRATIVE RULES RELATING TO MEDICARE SUPPLEMENT INSURANCE POLICIES

    This rulemaking amends the Insurance Division's rules governing Medicare supplement insurance in order to conform the rules to federal standards most recently adopted under the federal Medicare Prescription Drug, Improvement, and Modernization Act of 2003. The changes enable this state to retain federal certification of its Medicare supplement regulatory program.

  7. ADOPTS AND AMENDS OREGON ADMINISTRATIVE RULES RELATING TO INSURANCE PRODUCERS AND REGULATION
    (ID 08-2005)
    OAR 836-071-0108, etc.
    This rulemaking deals with a number of licensing issues, largely concerning insurance producers. The primary issue relates to disclosure of all compensation when the consumer pays compensation to the producer. Other changes: "agent" is replaced throughout the Insurance Division rules with "insurance producer;" Division rules governing felony waivers are extended; insurance producers are authorized to charge specific incidental charges; limited lines license categories are established; and the notice requirement for replacement of life insurance policies and annuity contracts is authorized to be limited to actual replacement transactions.

  8. AMENDS OREGON ADMINISTRATIVE RULE RULE RELATING TO TITLE INSURANCE
    (ID 07-2005)

    This rulemaking establishes a reserving requirement for title insurance for the year 2008 and each year thereafter, replacing a scheme that would have required an increasingly greater percentage over a longer period, arriving at ten percent in 2011 and years thereafter.
